The National Democratic Congress’ (NDC) candidate in the 2024 parliamentary election in the Kpandai Constituency, Daniel Nsala Wakpal, has prayed the Tamale High Court to charge the Chairperson of the Electoral Commission (EC), Jean Mensa, of contempt of court.

According to him, the Electoral Commission has failed to act on the orders of the court for a rerun of the parliamentary election in the constituency.

This is contained in a suit dated December 3, sighted by 3news. In the suit titled The Republic vs Jean Mensa, described the latter as the Respondent.

“That on 24″ day of November, 2025 the High Court per Emmanuel Bart-Plange Brew granted on order for a rerun of the Kpandai Constituency election on thirty (30) days, directed at the Respondent (Attached and Exhibited as -Exhibit DNW 1- is a copy of the Proceedings dated 24” November, 2025) (Attached and Exhibited as -Exhibit DNW 2 is a copy of the Court Order dated 24th November 2025).

“That the Respondent was served with this Order of the Court on the 25th day of November 2025 (Attached and Exhibited as *Exhibit DNW 3″ is a copy of the Proof of Service). That till date the Respondent has shown no sign of adhering to the said court order doted 24″ day of November, 2025,” Lawyers for Wakpal wrote.

They contended “That by the conduct of the Respondent it is clear that the Respondent has no intention to abide by the Court’s order dated 24th day of November. 2025. That I am advised by Counsel and verily believe some to be true that the test for determining whether an action amounts to contempt is whether the act complained of interferes or tends to interfere with the due administration of justice

” That I am advised by Counsel and verily believe same to be true that an act is deemed to be contemptuous when a person goes contrary to an order of a competent Court of jurisdiction,” they stressed.

“That in the circumstance, I pray that this obvious disregard of Respondent of the orders of the Court amounts to nothing more than contempt of which the Respondent ought to be convicted,” they demanded.
