Democracy Hub has filed a suit asking the High Court to order the Electroral Commission to decline the nomination filed by the candidate of the National Democratic Congress (NDC), Baba Jamal, in respect of the Ayawaso East by-election slated for March 3.

They cited the reported widespread incidents of vote buying during the February 7 primary, which the leadership of NDC acknowledged, yet cleared Baba Jamal to contest the election as their candidate

The suit has the National Democratic Congress (NDC) as 1st Defendant, the Electoral Commission as 3rd Defendant and the Attorney-General as the 3rd Defendant.

“An order of interlocutory injunction restraining the 2nd Defendant from: a. accepting the nomination of the said candidate; or b. permitting the said candidate to contest the by-election pending the final determination of this action,” Democracy Hub demanded.

They further sought “An order of perpetual injunction restraining the 2nd Defendant from recognising or dealing with the said candidate as the duly elected parliamentary candidate of the 1st Defendant for Ayawaso East.

“An order that any step taken pursuant to the impugned primary, including the submission and/or acceptance of nomination forms, is null and void.
9. An order directing the 2nd Defendant to ensure that any primary conducted under its supervision complies with the constitutional requirements of democratic participation, ” they added.
