The Court of Appeal has struck out as withdrawn an application by the Attorney-General to stay the execution of the acquittal of former MASLOC CEO Christine Sedina Tamakloe-Attionu.
State prosecutors on Wednesday, August 12 informed the court of a notice of withdrawal filed on August 10 after filing the application to stay the execution last month.
Sedina Tamakloe-Attionu was acquitted and discharged by the Court of Appeal after the court held that she was wrongly convicted in April 2024.
Sidney Antonio, lawyer for the former MASLOC CEO argued that the Attorney-General ought to have sought the leave of the court before filing any notice of withdrawal of its application.
“Today’s date was given by the court for the court to deliver its ruling and we were just served yesterday with a notice of withdrawal. We believe the proper thing should have been for the Attorney-General to have sought leave of the court before going ahead and withdraw because today’s business was for delivering of ruling and that should have gone on today,” h told the media after court proceedings.
Responding to claims that the A-G after withdrawing its stay of application filed at the Court of Appeal has filed same at the Supreme Court, he said “we have not been served formally with any such motion but as you have heard we have also heard about it.”
Following Sedina’s acquittal by the Apellate Court, the Attorney-General filed an application seeking to suspend the execution of the Court of Appeal’s judgment pending the determination of the State’s appeal.
The State argued that allowing the acquittal to take immediate effect could create an opportunity for Mrs Tamakloe-Attionu to leave the jurisdiction, potentially making it difficult to pursue the appeal.
However, that application at the Court of Appeal has been withdrawn by the A-G with suggestions same will be filed at the Supreme Court.
The Court of Appeal in July 2026 overturned the 10-year jail sentence handed to former Chief Executive Officer of MASLOC, Sedina Tamakloe Attionu.
Sedina was acquitted after the court ruled that the former MASLOC CEO should not have been sentenced, as the prosecution could not prove the charges levelled against her.
In April 2024, an Accra High Court handed Attionu a 10-year prison sentence with hard labour after finding her guilty of causing financial loss to the state.
She was convicted of 78 counts of offences, including stealing, causing financial loss to the state, money laundering.
