The Bolgatanga High Court has ruled in favour of the Vice-Chancellor of Bolgatanga Technical University (BTU), Prof. Samuel Erasmus Alnaa, and two other senior officers, ordering their reinstatement.
The University Council had set up a five-member committee to investigate the Vice-Chancellor over alleged procurement breaches and financial mismanagement involving GH¢27 million for the supply of computers, furniture, printers and other items. The investigation preceded their removal from office.
In its judgment, the court held that the University Council did not form a quorum when it took the decisions that led to the removal of the Vice-Chancellor and the two other officers. The decisions were therefore unlawful.
The court also found that the Special Investigative Committee set up by the Council was illegally constituted. It further ruled that the removal of Prof. Alnaa and the two officers was illegal.
The court granted the applicants’ request for an order of certiorari in full, quashing the Council’s decisions. Prof. Alnaa and the two senior officers are to return to office, and all other reliefs sought were duly granted.
Reacting to the ruling, Prof. Alnaa said the judgment is a major development for the University. He said it is expected to restore stability to its administration and bring relief to staff and students.
