A Supreme Court Justice nominee, Hafisata Amaleboba has debunked negative perception surrounding the distribution of marital properties among couples who wish to divorce.
Hafisata Amaleboba clarified that the law is not discriminatory towards a particular gender when it is considering the distribution of marital properties.
During her vetting on Wednesday, June 18, 2025, she noted that although there are some perceptions about the law being skewed towards one gender in terms of distribution of properties, such is not the case.
“When it comes to family law, the principles are applicable equally to men as it does to women. When it comes to distribution of marital properties, it is not based on gender even though it may seem so.
“Because Article 22 says that assets acquired jointly during marriage are to be distributed equitably irrespective of the gender so it is not in anyway discriminatory of any gender,” she explained.
Responding to the question about the position of the law on protection of children, she said: “the law is clear that in every matter affecting children, the welfare of the child is the court’s primary consideration.”
She further stressed that Ghana has a vibrant child support system which can be applied for by interested guardians.
“We have a child support in Ghana. You can bring an application to the Court for child maintenance.”
