The National Democratic Congress (NDC) has revealed its intentions to report Godfred Yeboah Dame, the Minister of Justice and Attorney-General (A-G) to the General Legal Council (GLC) and prosecute him at the right time.
This is after the party has disclosed to the public at a press conference next week, the evidence indicating the Attorney-General’s attempt to fabricate evidence against the Leader of the Minority in Parliament, Dr. Cassiel Ato Baah Forson.
This is due to a testimony given by one Richard Jakpa, an accused person in the ongoing trial involving the purchase of some ambulances for the state, has accused Mr. Dame of calling and meeting him at odd hours to give a false testimony against the first accused person in the case, Dr. Ato Forson.
During cross examination by counsel for the Minority Leader, Jakpa was cautioned by the trial judge, Justice Afia Serwah Asare-Botwe to be direct in his responses and avoid wasting the time of the court.
In response to the judge’s caution, Attorney-General Yeboah Dame accused Jakpa of defending the Minority Leader.
The accusation prompted Mr Jakpa to retort that the Attorney-General seemed aggrieved because he had previously failed to get him (Jakpa) to help the state build a case against Dr. Ato Forson.
“The A-G has on several occasions engaged me at odd hours to help him make a case against A1 and I have evidence for that.. If he pushes me, I will open the Pandora’s box. I don’t understand why the A-G will accuse me of defending A1 when I’m here to defend myself,” Mr Jakpa said in court.
“If he pushes me, I’ll open the Pandora’s box. I have evidence to all this,” he added.
Reacting to the issue on the KeyPoints on TV3 Saturday, May 25, 2024, the NDC’s Communications Officer indicated that the Attorney-General, if he had any defence for the testimony, would have done that in court rather than issuing a press statement afterwards.
He further stated that the party will provide evidence to the public in an impending press conference next week, adding that Mr. Dame’s actions are criminal according to the laws of the land.
Sammy Gyamfi indicated that the NDC, will report him to the GLC and initiate legal actions against him at the right time.
“…because if you check the Criminal Offences Act of Ghana, 1960, Act 29, Section 213 and 214, it talks about fabrication of evidence. You can’t bring any circumstance to exist which deceives a judge or a court about the existence of something which is not there. It is called fabrication of evidence.
“So if you are telling an accused person to come and bear false testimony against an innocent man, what you are seeking to do is that you want to fabricate evidence to deceive a court. And that is a criminal offence. And that is why I’ve been using the word criminally minded Attorney-General.
“I want you to know that I’m not here to attack anybody without sufficient grounds. And I want to put on record that Godfred Dame will be the first Attorney-General who will not only be reported to the General Legal Council for professional misconduct, but will be prosecuted for fabrication of evidence, which is a crime. Mark my words, this is going to happen,” he stated.
