Legal practitioner, Martin Luther Kpebu, has said the revelations made by the wife of former Finance Minister, Ken Ofori-Atta, about her husband’s surgery will not erode the bad faith surrounding his case.

Ofori-Atta’s attempt to get a time extension for his meeting with the Office of the Special Prosecutor (OSP), according to Kpebu, has been clouded with bad faith due to his failure to disclose in detail, what his real health condition was.

The lawyer, speaking on Ghana Tonight on TV3 Monday, June 16, 2025, indicated that the steps taken by the former Finance Minister will still haunt him.

“It’s still the same bad faith that has clouded this attempt by Ofori-Atta to get a further extension. The bad faith he exercised when he was seeking the postponement in February has caught up with him so now there is very little sympathy for his case,” he stated.

Kpebu explained that Ofori-Atta initially suggested he was undergoing a major surgery, but it turned out to be merely a diagnostic procedure, rendering his wife’s comments about his successful procedure irrelevant to his failure to meet the OSP’s timeline.

“The steps, the bad faith Ofori-Atta exhibited leading to his surgery is what will haunt him for a long time to come because you had a diagnostic surgery not a major surgery. It’s not a major surgery yet you took a long time, three months, only to go through diagnostic surgery. So the wife’s interview hasn’t advanced his case much.”

His comments follow a disclosure by his wife, that Ofori-Atta has successfully undergone a robotic-assisted radical prostatectomy at the Mayo Clinic in Rochester, Minnesota, to treat prostate cancer.

The procedure, which took place on Friday, June 13, 2025, lasted over four hours and was part of a planned treatment following a confirmed diagnosis earlier this year.

A Monday, June 16, 2025 statement released by his wife confirmed that the surgery proceeded as scheduled and that the medical team was now focusing on his postoperative care.

“The doctors are pleased with how the procedure went and will now place him on a postoperative regime,” the statement read.

This, is what the legal practitioner says wouldn’t justify the former Minister’s failure to meet the OSP since the surgery in question is not a major one.

“When you say possible surgical intervention everybody’s mind is on a major surgery not a biopsy,” Kpebu stated.

Ken Ofori-Atta is currently facing a legal challenge after the Office of the Special Prosecutor declared him a fugitive for failing to appear before it for questioning in an ongoing investigation.

The OSP maintains that it has not received any certified medical records or official documentation confirming his inability to return to Ghana.

Family of the former Minister, has, meanwhile, petitioned the INTERPOL Commission for the Control of Files, urging the withdrawal of the Red Notice alert placed on him by the OSP. They argue that the notice was issued without due consideration of his health condition and pending legal proceedings.

The family has expressed gratitude for the support and prayers received during this challenging period and reiterated Ofori-Atta’s commitment to cooperate fully with the OSP upon his recovery and return to Ghana.
