Private legal practitioner Martin Kpebu has said that the Special Prosecutor Kissi Ayebneg must be removed on account of incompetence.
Kpebu said that for him to have watched on for former Finance Minister Ken Ofori-Atta to leave the country was an act of incompetence for which he has to be removed.
“Kissi Agyebneg must go,” Kpebu said on the Key Points on TV3 Saturday, November 22.
Kpebu had also criticised Kissi Agyebeng, for not going public when he realised that state institutions were not cooperating with him to get Ofori-Atta, to remain in Ghana when he got wind that Mr Ofori-Atta was leaving the shores of Ghana.
The Office of the Special Prosecutor has faced heavy public scrutiny for failing to prevent the former minister from travelling to the United States despite ongoing investigations into his tenure.
Speaking in an interview on the KSM Show, Mr. Agyebeng said his office was handicapped because it did not have direct control over Ghana’s exit points, including the Kotoka International Airport.
He further noted that the security setup during that period appeared to have been working against his office, making it difficult to carry out its mandate effectively.
“We were not getting the cooperation of the other security agencies at the time he left for the States. We asked for all that we didn’t get. It was as if there was a policy of blocking the OSP out.
“That is what we were facing, and those are the circumstances we were being expected to perform. I think I complained about this. The security was set up against the OSP so that we would not be able to perform our job.
“He left before 7th January, between 1st and 6th January. I know the exact date, but I am not going to say it. Who was in power during those few days? And we don’t control the airport,” Kissi Agyebeng said.
Reacting to this on The Ghana Tonight show on TV3, Wednesday, November 5, Martin Kpebu said that “Kissi Agyebeng was aware, but he said public institutions were not cooperating and so he kept quiet when he was required to bring it to the attention of the populace. Sovereignty is in us; it doesn’t reside in the president so it is no answer to say that. I can’t believe that this is the Kissi Agyebeng I have known all these years, that he is so timid.”
He added, “I can’t trust Kissi Agyebeng again. I have known Kissi for over 20 years, but this misjudgment is so basic that I have lost trust for him.”
In a subsequent post on his Facebook page, Kpebu said “So Prof Gyampo was right when he said Kissi Agyabeng is not the conscience of the nation. ORAL was working when Ken Ofori-Atta left yet KA didn’t see fit to blow the whistle to ORAL that KOA is about to flee. ORAL had SECURITY CAPOS who could help. No press conference either. And you think you have a special prosecutor? WALAHI TALAHI we are finished but b4 then, Kissi must leave that office first. This is just a tip of the iceberg. He did worse things. They would all come out one by one.
“Gyampo, come for your stone. I’m gobsmacked. What a sin thing. You betray the people of Ghana like this and expect to stay on? What happens to the Constitution (1992)-sovereignty resides in the people in the preamble, articles 1, 35 and 125? “SO, THE AIR OF LIBERATION AFTER THE ELECTIONS COULDN’T SPUR HIM ON TO BLOW THE WHISTLE? ORAL must work. Is Kissi Agyabeng an enemy of progress (against the corruption fight)? OSP is not for timorous souls. BOLD SPIRITS we need.”
