A member of the Council of State, Sophia Abena Boafoaa Akuffo, has inferred that Dr. Johnson Asiamah, who has been named as the Governor of the Bank of Ghana (BoG) is not yet an appointee.
She says until the process of appointing a governor to the BoG is completed as stated in the Constitution, he remains a nominee and not an appointee.
According to her, the appointment is supposed to follow a process and until that process is exhausted, the nominee cannot take the office as codified in the law.
The former Chief Justice, speaking on Hot Issues on TV3 with Keminni Amanor, indicated that if the Constitution has a provision on the appointment, and if, it is a process, then it needs to be satisfied before there can be an appointment.
“Firstly, does the law say anything? And What does the law say? What is says is that the appointment is made in consultation. So at best, even if you see it as a process, that process does not conclude without the consultation of the Council of State,” she said Sunday, February 23, 2025.
Her comments come on the back of President Mahama’s appointment of Dr. Johnson Pandit Asiamah as Governor of the BoG which the Minority in Parliament has raised concerns about, regarding the non-existent of the Council of State at the time to approve of his nomination.
Reacting to the issue, Madam Akuffo indicated that although she is not going to make a judgement call on theĀ development, she maintains the process must be completed as enshrined in the Constitution.
“I’m not going to make a judgement call on it. All I’m saying is that a process was not complete. And sometimes when you’re in a position to do something, you may be ill-advised or you may have misunderstood the process but you need to complete what you have started.
“So, somebody might be spotted, somebody might even be named, but that person is appointed after a certain procedure,” she reemphasised.
When asked for clarification on her stance that “unless that name has come to Council of State, then there is no appointee yet, it’s just somebody who has been named?” she responded, “yes, a nominee, a designated person.”
