The Office of the Attorney-General has urged an Accra High Court to strike out yet another case filed by Chief Justice Gertrude Torkonoo.
The Chief Justice is in court once again seeking to halt the ongoing impeachment process insisting one of the entities behind the petition, Shining Stars of Ghana does not have a legal status.
Documents filed on behalf of the A-G by Deputy Attorney-General Dr. Justice Srem Sai on August 12, wants the High Court to rule that the Chief Justice’s request has no basis in law.
Dr. Sai first argues that the issues raised by the Chief Justice are matters which fall within the purview of the committee probing the petitions.
He adds that they are therefore covered by the in-camera rule and can therefore not be admissible in court.
On the question of the legal status of Shining Stars of Ghana, the Attorney-General says the entity may be an unincorporated body of persons.
Dr. Sai adds that such an entity does not necessarily have to be incorporated or registered to exist in law. He therefore urges the Court to strike out the case filed by the Chief Justice.
The Chief Justice has in the last few weeks not been successful in multiple attempts to halt her impeachment process.
