Private legal practitioner and Vice President of IMANI Africa, Kofi Bentil, has described the law against the publication of false news as unconstitutional.
He makes the point that if news is harmful defamation, the remedy is for the victims to sue the publisher, not the Police arresting the person.
“It is clearly unconstitutional. If the news is false, it’s not a crime. If news is harmful, defamation is available,” he wrote on Facebook, reacting to the arrest and detention of a suspect for allegedly publishing false news for a long time and did not put him before the court.

Similarly, the Executive Director of the Media Foundation for West Africa (MFWA), Sulemana Braimah shared the same sentiment and further questioned why the Police would arrest a suspect for the publication of false information, following a complaint.

He noted that on a daily basis, people publish false information about others and further asked whether the police will now be arresting all such persons.

“Why will the Ghana Police be arresting and detaining people for publication of “false news” about private individuals or even public officials? Individuals cannot or should no longer sue for defamation because the police will act on their behalf? The police will now be arresting, detaining and taking people to court for defamation on behalf of individuals?

“Even in the days of criminal libel, this will not be acceptable. On daily basis we have people publishing false information about others. Will the police now be arresting all such persons? These acts must stop,” he wrote on Facebook after

On Thursday, November 20, the Ghana Police Service, with support from the National Signals Bureau (NSB), arrested suspect Samuel Amadotor for alleged malicious publication of false information.

According to the Police, this was after a complaint against him by Mr. Okatakye Boakye Danquah Ababio I.

The Police said in a statement that upon interrogation, the suspect admitted to the offence and mentioned one Chairman Michael Yeboah as the one who contracted him to make the false publication.

“The said Chairman Michael Yeboah is being sought to assist the investigation. Meanwhile, the suspect is in custody and will be put before the court tomorrow, 21st November, 2025,” the statement said.

This was after another journalist, Ansah-Addo Halifax, had written on Facebook about the arrest.

Halifax said, “Sammy Amedetor, editor of Dklassgh.com.  He was picked at 3am from his bed, handcuffed and sent to Signals Bureau last Friday. Questions centered mainly on who gave him the video he published and later pulled it down. He was released around 11pm same Friday and asked to report back to Signals Bureau on Tuesday.  He did.

“Since Tuesday, he is still LOCKED at the Ministry of Police station as I type. Since when did not disclosing a source became a crime?”

Meanwhile, Blogger Samuel Amadotor (Dklassgh.net) has been granted GH¢50000 bail by an Accra Circuit Court after being charged with publishing false news.
