Legal practitioner and social activist, Martin Luther Kpebu, has urged Alexander Kwamena Afenyo-Markin, not to appeal the dismissal of his defamation suit against GoldBod CEO, Sammy Gyamfi.

He says although they have the right to appeal, it would be better to abandon the case in the interest of Ghana’s democracy.

His comments follow the dismissal of the Minority Leader’s suit against Sammy Gyamfi, which the General Jurisdiction 1 Division of the Accra High Court, presided over by Justice Agyenim Boateng, on Wednesday, October 14, 2026, threw out.

The Court held that the writ of summons filed on August 24, 2026, was defective and failed to meet the mandatory requirements for libel actions under Order 57 Rule 2 of the High Court Civil Procedure Rules, C.I. 47.

The suit arose from public exchanges over alleged losses of US$1.7 billion linked to the Bank of Ghana’s Domestic Gold Purchase Programme.

Afenyo-Markin had raised concerns over the losses, after which Sammy Gyamfi described him as an “extortionist” on JoyNews on Saturday, August 22, 2026. The Minority Leader subsequently sued Gyamfi and the Multimedia Group Limited for GH¢15 million in damages, a retraction and an apology.

Despite the dismissal, Afenyo-Markin and his lawyers have indicated their intention to appeal the decision.

Speaking on Ghana Tonight on TV3 on Wednesday, October 15, Kpebu said he would have wished that Afenyo-Markin allows the matter to rest.

“I would have wished that Afenyo-Markin and his lawyers don’t go on the appeal. They should let sleeping dogs lie. But if they’ve chosen to go, all is not lost,” he stated.

He also called on statesmen to intervene and broker peace between the two political figures, considering the consequences of the suit on the integrity of Ghana’s democracy.

“I pray that there will be some Statesmen who can call the two parties and seek to broker peace because it doesn’t build well for our democracy,” he added.
