Christian Lebrecht Malm-Hesse, a Private Legal Practitioner, has disagreed with views expressed against televising proceedings of the committee hearing petitions for the removal process of the Chief Justice Justice, Gertude Torkornoo.
His comments come amid heated debate over whether the impeachment proceedings against Chief Justice Gertrude Torkornoo should be held in-camera or opened to the public.
The suspended Chief Justice of the Republic, Justice Gertrude Araba Esaaba Sackey Torkornoo, has filed a writ at the Supreme Court seeking, am ong other things, a declaration that she can waive the privilege given to her under Article 146 (6) (7) and (8) for an in-camera hearing on proceedings for her removal from office.
Speaking to Helen Appiah-Ampofo on 3FM Morning Show Sunrise on May 22, the legal practitioner believes “the suspended Chief Justice, Torkornoo can waive her right to in-camera hearing even though the Constitution doesn’t allow so.”
He further argued that “I think the CJ wants the camera hearing so Ghanaians can see how she’s being handled by the court, to be their own judge of the situation.”
The legal practitioner again argues that “Gertrude Torkornoo’s concerns and grievances concerning the committee’s probe are legitimate.”
In a suit filed at the Supreme Court on Wednesday, 21 May 2025, by lawyer for the Chief Justice, Godfred Yeboah Dame, with suit number J1/22/2025, with the Chief Justice, Her Ladyship Gertrude Araba Esaaba Sackey Torkornoo, as plaintiff and the Attorney-General as the first Defendant, the Chief Justice is also asking the Supreme Court for an additional 15 other reliefs.
The suit also names all five committee members President John Dramani Mahama set up to investigate the allegations against the Chief Justice as defendants in the case.
The Chief Justice wants Justice Gabriel Scott Pwamang and Justice Samuel Adibu-Asiedu removed from the committee because she says they are conflicted. The other committee members named as defendants in the suit are Daniel Yao Domelevo, Major Flora Bazwaanura Dalugo, and Pressor James Sefah Dzisah.
