The Accra High Court has told lawyers of defunct Menzgold Chief Executive Nana Appiah Mensah (NAM1) that his evidence will be taken via electronic means.
The court acknowledged receipt of a doctor’s note preventing NAM1 from physically exerting himself.
Nana Appiah Mensah is facing multiple counts of defrauding by false pretense, operating a gold firm without license and money laundering.
He has pleaded not guilty and is on bail.
The embattled CEO was expected to continue with his evidence in chief on Monday; however, when the case was called, he was absent.
Presiding judge Sedinam Kwadam intimated that the accused had presented a medical excuse to explain his absence.
Details of the document suggested that the Menzgold CEO should not be subjected to maximum physical exertion citing that he needed at least three weeks to recuperate.
Yaw Kyereh Adu, holding brief for the lawyers of NAM1, prayed the court to give the accused 3 weeks off to help him get in the right frame of mind to return to court.
“It’s our prayer that the first accused be afforded the 3weeks prescription by the doctor. Our only prayer is that the first accused be in the right frame of mind to be able to give his evidence in chief in readiness of the Cross-examination.”
But Justice Kwadam noted that the medical document did not restrict the accused person from continuing and ruled that the case will be continued virtually with a video link to be provided to NAM1 to continue with his evidence in chief and subsequent cross-examination.
The court further ordered the defense lawyers to file their documents and adjourned the case to Wednesday for continuation.
