The Agbogbomefia of the Asogli State, Togbe Afede XIV, has said some recent interpretations of the constitution by the Judiciary have been uninspiring and illogical.
The recent impasse between the Speaker of Parliament and the judiciary have raised alarm in the country causing many to question the fate of Ghana’s democracy.
According to the eminent chief, the judiciary should be known as the arm of government that exist to protect all citizens rather than being seen as a predictable institution.
His concerns stem from a comment from a former judge of the Supreme Court, Justice William Atuguba, where he raised concerns over the empaneling of the judges in the matter involving the vacant seats controversy.
The panel ruled in favour of the leader of the NPP caucus in Parliament, Alexander Kwamena Afenyo-Markin, where he challenged Speaker Alban Bagbin’s decision to declare four parliamentary seats vacant.
Justice Atuguba described the majority ruling as “predictable” given the panel’s makeup.
Speaking on the ruling, Togbe Afede in an interview with journalists on the sidelines of the 9th Congregation of Ensign Global College at Kpong in the Lower Manya Krobo Municipality of the Eastern Region Sunday, November 17, 2024, lamented the state of the judiciary and its recent interpretations of the law.
“It’s unfortunate that a former Supreme Court justice said the judiciary has become very predictable, it’s unfortunate. And some of the decisions that have been made by the judiciary have not been very inspiring.
“We want the judiciary that we all know exists to protect all of us, ensure freedoms, and ensure fair justice delivery. But happenings recently have given us cause for concern. Sometimes, in some ways the laws interpreted just defy logic.
