Justice Abdulai, a lecturer at the Law Faculty of the University of Professional Studies, Accra (UPSA), has advised the Office of the Special Prosecutor (OSP) to seek judicial review on the High Court’s ruling over the Office’s prosecutorial mandate.
He says an appeal by the OSP’s outfit and seeking judicial review is the surest way the matter which has become a public debate will be laid to rest.
Speaking on TV3’s Ghana Tonight on Monday, April 20, 2026, Justice Abdulai said the apex court could quash the High Court’s ruling if the OSP appeals the matter just as the Office has already indicated.
“The OSP should mount an immediate appeal which it had already indicated its willingness to do, and in addition, file a judicial review at the Supreme Court immediately. A judicial review will then question and has the potential of quashing the decision of the High Court,” he stated.
“Admittedly this is a High Court decision and so it does not have the same level of authority and influence as a Court of Appeal or a Supreme Court decision would have been,” he stated.
Justice Abdulai explained further that the decision of the court can potentially influence other High Court judges which will likely undermine the activities of the OSP.
“But it does have that level of influence to agitate the minds of other High Court judges to tow similar line and you wouldn’t have that otherwise it will curtail any potential prosecution or any other activity the OSP would be undertaking from today,” he stated, stressing on the need for the Office to take up the two actions to put the matter at the appropriate perspective.
“So, it is important that they mount these two strong approaches against the High Court, –filing the appeal and going for judicial review at the Supreme Court,” he advised.
