Five persons claiming to be the immediate maternal principal family members of the late Charles Kwadwo Fosu (Daddy Lumba), have filed a writ praying the High Court in Accra, among others, to prevent the release of the deceased’s body to anybody without their consent.
The Plaintiffs are; Obaapanyin Afia Adomah Pakoso of Kumasi, Rober Gyamfi a.k.a Wofa Yaw Poku Asuafua of Kumasi, Georgina Gyamfi of Kumasi, Ernestina Fosuh of Kumasi and Nana Afia Kobi Pakoso also of Kumasi.
“An Order directed at the 3rd Defendant not to release the body of CHARLES KWADWO FOSU AKA DADDY LUMBER to any person(s) without the knowledge, consent, and approval of the Plaintiffs,” they demanded of the court.
The suit, dated December 3, named the defendants as; Kofi Owusu Abuakwa of Kumasi, CAL Bank Headquarters, Accra, and Transitions Funeral Home, Haatso Accra.
The plaintiffs also requested the court to grant “An Order of the Court restraining the 1st defendant and any other member of the old committee from accessing the Account NO. 1400009943457 with account name DADDY LUMBA MEMORIAL FOUNDATION LBG at CAL Bank Ghana.
“An Order directed at the 1st Defendant to account, surrender, submit, refund etc any item and or funds withdrawn from the DADDY LUMBER FOUNDATION account after the dissolution of the committee previously formed by the 1st Defendant.
“An Order restraining the 2nd Defendant from honouring any cheque presented to it by the 1st Defendant or under his authority and or any member of the dissolved committee in respect of Accounts NO. 1400009943457 Which is DADDY LUMBA’s funeral accounts.
“An Order directed at the 2nd Defendant to remove the signatories to the DL FOUNDATION ACCOUNT and substitute same with the signatures of the newly formed committee members who may be appointed by the head of the immediate family of the late CHARLES KWADWO FOSU AKA DADDY LUMBER.
“An Order of perpetual injunction restraining the Defendants either by themselves, agent, assigns, workmen etc or anyone claiming through him from having anything to do with the final funeral rites of the late CHARLES KWADWO FOSU AKA DADDY LUMBER.”

Meanwhile, the late music icon is scheduled to be burried on Saturday, December 13.
