The re-collation of parliamentary results in Techiman South, Ablekuma North, Okaikwei Central and Tema Central in the 2024 elections have been quashed by the Supreme Court.
It has subsequently asked that results of these constituencies be collated again, excluding the Ahafo Ano North and Nsawam Adoagyiri results which were part of seven of nine constituencies which were re-collated by the EC.
Results of the said constituencies were re-collated following a High Court ruling.
But according to the apex court, the trial judge violated the right to a hearing of the parliamentary candidates of the National Democratic Congress (NDC) when they applied to the High Court.
The order directly goes against a re-collation made by the Electoral Commission described by many as controversial, and subsequently declaring results, some of which contravened an earlier announcement made by the EC itself after the elections.
The Commission had alleged that some of the results were announced by their officials under duress, and needed to be re-collated, of which all the seven of the nine disputed constituencies went to the governing New Patriotic Party.
Despite quashing the results, the sitting judge noted that the application for mandamus remains alive and has to be heard and determined by the High Court on Tuesday, December 31, 2024.
The mandamus application at the High Court, however, must be heard by a different judge, per the ruling.
The NDC had, meanwhile, accused the High Court trial judge of being biased for ordering a re-collation of the results in the disputed constituencies, amid accusations of procedural errors.
The now-quashed December 20 ruling, had directed the EC to re-collate results in nine constituencies where irregularities were alleged.
The decision followed a mandamus application filed by New Patriotic Party (NPP) parliamentary candidates, who argued that discrepancies in the tabulated results required verification to uphold transparency and accuracy.
The EC has since complied with the order in seven constituencies, but the re-collation for Dome-Kwabenya and Ablekuma North remains incomplete.
