Alan John Kwadwo Kyerematen, the Presidential Candidate of the Alliance for Revolutionary Change, has advised the Speaker of Parliament to file another application at the Supreme Court to challenge its earlier decision.
This is in respect of the suit by the Speaker that sought to overturn the verdict of the Supreme Court on the ruling that declared some four seats in Parliament vacant which was dismissed.
At a Thursday, October 31, 2024 press conference held by Mr. Kyerematen, he urged the Speaker of Parliament to first accept the ruling of the Supreme Court and file another application for the court to vary the decision.
He says the Speaker’s application to the court to overturn the decision it earlier made was misguided, advising that another application for variation of the verdict would be the best thing to do.
Mr. Kyerematen, nonetheless, commended the Speaker’s decision for declaring the seats vacant as directed by the constitution and the Standing Orders of Parliament.
“Bagbin must accept first the decision of the Supreme Court to grant an injunction that operates as a stay of execution of his initial order. He must accept the second decision of the Supreme Court to throw away their application.
“He must bring another application to the Supreme Court, requesting the Supreme Court to vary its earlier decision to grant an injunction in respect of the matter.
He asked the Speaker to be explicit in his next application to establish that the issue of interpretation does not arise in the matter.
“And the basis for the application must be that on the face of the provisions of the Constitution, there is no issue arising in respect of interpretation. So it means that Afenyo-Markin’s application to the Supreme Court to injunct Parliament and to stay the execution of the ruling of the Speaker in itself is not proper.
“It is not proper because it does not need interpretation of a particular provision, then you cannot call upon the Supreme Court by force to make an interpretation,” he stated.
On the other breath, he admonished the apex court to recognise the separation of powers between the arms of government, urging it to accord Parliament its respect and autonomy of the Speaker’s decisions.
Reemphasising the importance of the cooperation between the arms of government, the former Trade and Industry Minister established the repercussions of the melee between them, especially when the December elections are few weeks away.
He therefore called on the two bodies to swiftly resolve the matter to ensure sanity.
