Legal practitioner, Martin Luther Kpebu, has reiterated his call for Special Prosecutor (SP), William Kissi Agyebeng’s removal from office, accusing him of betraying the nation.

Kpebu claims Agyebeng’s actions are in conflict with the principles of his office, rendering him unfit to serve. This demand comes amid the controversy, including the exit of former Finance Minister, Kenneth Nana Yaw Ofori-Atta, from the country.

The lawyer believes there was much the Office of the Special Prosecutor (OSP) could have done to prevent Ofori-Atta from fleeing the country, but instead, it stayed aloof and allowed him to escape.

This has led Kpebu to question Agyebeng’s claim of being the conscience of the nation.

His comments follow a statement by Kissi Agyebeng on the KSM show, where he explained that he lacked the power to prevent Ofori-Atta from leaving, citing the difficulty in cooperating with security agencies due to Ofori-Atta’s relationship with then President William Addo Dankwa Akufo-Addo.

“He left between December 1 and 7. Who was in power at that time? And we don’t control the airports and exit gates. But we’re taking flak, why allow him to leave? His cousin was President, Nana Akufo-Addo. Let’s face facts,” he pointed out.

Kissi Agyebeng added that “we were not getting the cooperation of the other security agencies at the time he left for the States. We asked for all that we didn’t get. It was as if there was a policy of blocking the OSP out.”

“That is what we were facing, and those are the circumstances we were being expected to perform. I think I complained about this. The security was set up against the OSP so that we would not be able to perform our job.

“This is the situation we found ourselves in, and I’m being asked how we let Ofori-Atta flee. We didn’t watch him leave. But we couldn’t prevent him from leaving the airport. We were powerless,” he further explained.

But in a post on his Facebook page Thursday, November 6, 2025, the legal practitioner and anti-corruption crusader alleged that the Special Prosecutor has done worse things that are yet to come to light, reemphasising the need to remove him from office to aid the fight against corruption.

According to the lawyer, who is part of the Operation Recover All Loot (ORAL) committee, other members on his team with experience as security operatives could have helped stop Ofori-Atta if the OSP had given them a tip-off.

“So Prof. Gyampo was right when he said Kissi Agyabeng is not the conscience of the nation,” he stated.

“ORAL was operational when Ken Ofori-Atta left, yet KA (Kissi Agyebeng) didn’t see fit to alert ORAL that KOA (Ken Ofori-Atta) was about to flee. ORAL had security personnel who could have helped. No press conference either. And you think you have a special prosecutor?” he questioned.

He went on to say that the OSP must leave, a call he has been making for some time now, commending Prof. Ransford Gyampo, a political science lecturer at the University of Ghana, who criticised Kissi Agyebeng for describing himself as the conscience of the nation.

“Walahi, Talahi, we are finished, but before then, Kissi must leave that office first. This is just the tip of the iceberg. He has done worse things. They will all come out one by one.”

“Gyampo, come for your stone. I’m gobsmacked. What a sinful thing. You betray the people of Ghana like this and expect to stay on?” Kpebu added.

 

Kissi Agyebeng’s comments about Ken Ofori-Atta’s exit from the country follow the Office of the Special Prosecutor’s announcement to press charges against several individuals implicated in the controversial revenue assurance contracts between the Ghana Revenue Authority and Strategic Mobilisation Ghana Limited by the end of November 2025.

Those expected to face prosecution include the former Finance Minister Ken Ofori-Atta, former Commissioner-Generals of the GRA — Dr. Ammishaddai Owusu-Amoah and Emmanuel Kofi Nti — as well as GRA officials, Isaac Crentsil, and Kwadwo Damoa. Ernest Akore, former Technical Advisor at the Ministry of Finance, will also be charged by the Special Prosecutor.

The decision follows months of investigations by the OSP, which uncovered alleged acts of corruption, abuse of office, and breaches of procurement laws in the award and execution of the SML-GRA contracts.

Meanwhile, the OSP says extraditing Ofori-Atta from the United States to the country remains uncertain, citing the complexities of international law and diplomatic protocols.
