President John Dramani Mahama has affirmed the need for an effective Office of the Special Prosecutor with special prosecutorial powers.
According to the President, recent disputes over the legality of the Office remain subject to appeal and interpretation by the Supreme Court of Ghana.
In an address to mark May Day in Koforidua on May 1, 2026, he stressed that the Government remains confident in the relevance of the institution in Ghana’s anti-corruption architecture.
“Recently there have been legal disputes about the constitutionality of the Office of the Special Prosecutor. While some of the issues are pending appeal and Supreme Court interpretation, Government believes that there is space for an effective Office of the Special Prosecutor with special powers of prosecution,” he stated.
He further indicated that the Government is taking steps to reinforce the legal framework of the Office of the Special Prosecutor despite ongoing legal challenges regarding its prosecutorial powers.
President Mahama further revealed that the government, through the Attorney-General’s Department, has laid a bill before Parliament aimed at establishing regional tribunals to support the administration of justice.
The proposed tribunals are expected to enhance the prosecution of corruption-related cases and improve access to justice across the country, particularly in regions outside Accra.
The move forms part of broader efforts by the government to strengthen accountability institutions and ensure the effective enforcement of anti-corruption laws.
The Office of the Special Prosecutor was established to investigate and prosecute corruption and corruption-related offences, but its operations have recently come under scrutiny due to legal questions surrounding its prosecutorial mandate.
There is currently a case at the Supreme Court seeking constitutional interpretation of the legality of the OSP. When settled, this will help clarify ambiguities and reinforce the institutional framework needed to tackle corruption more effectively.
