A private legal practitioner, Christian Malm-Hesse, has stated that the petition calling for the removal of the Chairperson of the Electoral Commission (EC) and her deputies will be thrown out if the allegations against them are merely electoral issues.

He says such matters have their jurisdictions where they are addressed. According to him, if the concerns in the petition do not bother on their competence, it would not suffice for the call.

His comments come on the back of a petition filed by one Kwame Ofosu-Appiah, seeking the removal of the Electoral Commission (EC) Chairperson and her deputies.

Ofosu-Appiah, has stated amongst his reasons in the petition that certain comments made by some members of the Commission prior to their appointment are grounds for removal.

He also stated that Madam Jean Mensa used her discretion to disenfranchise residents of Santrokofi, Akpafu, Likpe, and Lolobi (SALL) in the 2020 parliamentary elections.

Speaking on Ghana Tonight on TV3 Monday, January 27, 2025, lawyer Malm-Hesse indicated that the procedure for the removal will follow the same process as the one filed against the Chief Justice where a committee will be set to determine whether there is a prima facie case against the people.

He explained that the committee’s “responsibility will basically be to establish whether a prima facie case has been made and if the allegations made are merely electoral disputes, then they will not stand the test of time because electoral disputes are resolved at the electoral courts as we have seen proactively, the CJ is trying to have certain judges to hear these matters expeditiously as we have all witnessed.

“So, if they’re merely embedded with matters that could be resolved [by the] judiciary and does not affect or indict the EC as it is, in terms of her competence or it does not alter her competence, they will be thrown out as merely assertions and not have any basis in law and for that matter, the constitutional legal frame of act has not been satisfied.”
